This Privacy Policy outlines how MagicFurnish and its affiliates (“we,” “us,” or “our”) collect, use, and disclose information when you interact with MagicFurnish through our platform, mobile apps, email newsletters, online subscriptions, or any other services that display this Privacy Policy (collectively referred to as the “Services”).
1. Information We Collect
We collect the following types of information:
1.1 Personal Identifiers: Includes name, email address, and any other information you voluntarily provide when interacting with our services. This information is collected during account registration, subscription sign-up, customer support interactions, and when you submit interest in a residence through our Services.
1.2 Usage Data: Includes details about how you use our Services, including interactions with our platform, uploaded floor plans, page visits, session duration, referral sources, and engagement metrics. This data helps us understand user preferences and optimize the platform experience.
1.3 User-Generated Content: Includes floor plans, layout designs, and any other content uploaded through the platform, whether submitted directly by individual users or transmitted via an authorized third-party integration (such as a real estate platform, property management system, or enterprise partner embedding our Services). Floor plan data submitted through partner integrations is processed on behalf of the partner and subject to the data-sharing terms in Section 3.2. Such content may be used for service delivery, feature improvement, and experience personalization. We do not claim ownership of user-generated content.
1.4 Communication Data: Includes information you share when communicating with us, such as customer service inquiries, survey responses, and feedback. We use this information to respond to your requests and improve our Services.
1.5 Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to track your interactions with our Services. These technologies help us collect data for analytics, customization, and targeted marketing. We also use browser local and session storage to hold session identifiers and, where you have submitted interest in a residence or agreed to share your email address with property teams, the email address itself. Information stored through these browser technologies is stored on your device and can generally be removed by clearing your browser's site data. Information submitted as part of an inquiry may also be retained in our systems as described in Section 5.
1.6 Information from Other Sources: We may receive data from third-party partners and combine it with information we collect for analytics and service improvement.
1.7 Embedded Integration Data: MagicFurnish is available as an embeddable component within third-party platforms operated by our enterprise partners ("Partner Platforms"). When you interact with MagicFurnish through a Partner Platform, we may collect a session reference identifier ("ref") supplied by the partner to associate your session with a listing or property record. We generally do not receive your name, email address, or other direct personal identifiers from the Partner Platform solely because you use the embedded experience. However, we may collect your email address if you voluntarily create a MagicFurnish account or submit interest in a residence through the embedded experience. Property inquiry information is handled as described in Sections 3.6 and 3.7. The Partner Platform's own privacy policy governs data collected by that platform independently of our Services.
2. How We Use Your Information
We use your information to:

2.2 Communicate updates, promotions, and relevant service information via email or in-app notifications.
2.3 Perform data analysis to understand user behavior and optimize our platform.
2.4 Monitor and enhance the security and functionality of our Services, including detecting unauthorized access or misuse.
2.5 Comply with legal obligations, enforce our terms, and resolve disputes.
2.6 Conduct research and development to improve existing features and introduce new services.
2.7 2.7 Facilitate connections you initiate with the uploader, agent, property team, or other listing-side recipient associated with a listing, as described in Section 3.6.
3. Sharing Your Information
3.1 Service Providers: We may share your information with trusted third-party service providers to facilitate payment processing, data analytics, customer support, and technical maintenance. These providers are contractually bound to protect your data.
3.2 Partners: We may share aggregated or anonymized usage data with retail, commercial, or enterprise partners to enhance product offerings and improve user experience. Individual user identities are not disclosed without your direction or explicit consent, except as described in Sections 3.6 and 3.7. For information that a Partner Platform transmits to MagicFurnish so that we can operate an embedded integration on that partner's behalf, we may act as a data processor or service provider to the partner. Information that you provide directly to MagicFurnish, including through a property inquiry, is handled as otherwise described in this Privacy Policy.
Partners are responsible for ensuring that their end users are informed of MagicFurnish's involvement where required through their own privacy notices. For enterprise partners that embed MagicFurnish within their platforms, we operate as a data processor on their behalf with respect to any session or listing data transmitted to us through the integration. In this capacity, we process data only as instructed by the partner and in accordance with applicable data protection laws. Partners are responsible for ensuring that their end users are informed of MagicFurnish's involvement through their own privacy notices.
3.3 Business Transfers: In the event of a merger, acquisition, or asset sale, your information may be transferred as part of the transaction. We will notify you if your data becomes subject to a different privacy policy.
3.4 Legal Requirements: We may disclose your information when legally obligated to do so, such as in response to a court order, subpoena, or other legal process, or when we believe disclosure is necessary to protect our rights or the safety of others.
3.5 Sub-Processors: We engage the following categories of third-party sub-processors to operate our Services:

All sub-processors are contractually required to maintain data protection standards no less protective than those described in this policy. Enterprise partners may request an updated sub-processor list by contacting peter@magicfurnish.com.
3.6 Property Inquiries: When you indicate interest in a residence through our Services, you direct MagicFurnish to disclose the email address submitted with your inquiry to the uploader of that layout and to the partner, agent, property team, or other listing-side recipient associated with the residence so they may contact you about it. If you are signed in, we may use the email address associated with your account. Before we do so for the first time, we show you the address that will be shared and explain that later inquiry submissions may share it in the same manner without asking you to enter it again. You may use a different email address instead. This disclosure is made at your direction and relates to the listing for which you submitted the inquiry. We do not include your name, unrelated browsing history, or other layouts you have viewed as part of the inquiry disclosure unless we separately tell you. Inquiry submissions are transmitted promptly and cannot be recalled once sent. If you would like us to delete eligible inquiry information from MagicFurnish's own records, or would like assistance asking a recipient to stop contacting you, contact us at support@magicfurnish.com. Deletion from MagicFurnish's systems does not necessarily delete copies independently retained by the recipient.
3.7 Enterprise partners and uploaders may have access to analytics covering their own listings. Where a viewer has submitted interest in one of those listings, the email address provided with the inquiry may appear in the applicable partner's activity records alongside the relevant listing and the time of submission. We provide identifiable inquiry information for the purpose of allowing the applicable uploader, agent, partner, or property team to respond to and manage inquiries concerning its listings.
4. Cookies and Tracking Technologies
We use cookies to enhance user experience, analyze performance, and provide targeted advertising. You can manage cookie preferences through your browser settings. Disabling cookies may affect your ability to use some features of our Services. Cookie-blocking controls do not necessarily remove information stored through browser local storage or session storage. To remove information stored through those technologies, you may need to clear the browser site data associated with the Services.
5. Data Retention
We retain your personal information as long as necessary to fulfill the purposes outlined in this Privacy Policy, including legal, regulatory, and operational requirements. Furnished layout outputs (including gallery URLs) generated through our Services are retained as permanent artifacts associated with the applicable listing or session record. When personal data is no longer needed for the purposes described herein, we securely delete or anonymize it. Enterprise partners may request deletion of session data associated with their integration by contacting us at support@magicfurnish.com. Inquiry records, including the email address submitted, the listing to which the inquiry relates, and associated submission information, are retained for as long as reasonably necessary to operate and document the inquiry, support the applicable partner's business records, comply with legal or contractual obligations, and resolve disputes. Eligible inquiry information may be deleted or anonymized upon request as described in Section 6. Deleting an inquiry from MagicFurnish's systems does not recall or automatically delete information already transmitted to an uploader, agent, partner, or property team.
6. Your Rights
You have the right to:
6.1 Access: Request details of the personal information we hold about you.
6.2 Correction: Request corrections to inaccurate or outdated information.
6.3 Deletion: Request deletion of your personal data, subject to legal obligations and legitimate business interests.
6.4 Restriction: Request that we limit processing of your data in certain circumstances.
6.5 Objection: Object to our processing of your data where applicable under relevant laws.
6.6 Data Portability: Request a copy of your personal data in a structured, commonly used, and machine-readable format.
6.7 Opt-Out: Unsubscribe from marketing communications or exercise any applicable right to opt out of data sharing for targeted or cross-context behavioral advertising. You may also ask us to delete eligible inquiry information from our systems or assist you in asking the applicable listing-side recipient to stop contacting you. An inquiry that has already been transmitted cannot be recalled, and a recipient may maintain its own copy subject to its privacy practices and applicable law.
7. Security Measures
We implement reasonable and appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit using TLS, access controls limiting data access to authorized personnel, and regular review of our security practices. In the event of a data breach that affects your personal information, we will notify affected parties and relevant authorities within a commercially reasonable timeframe consistent with applicable law. Despite these efforts, no method of data transmission or storage is completely secure, and we cannot guarantee absolute security.
8. International Data Transfers
If you access our Services from outside the United States, your data may be transferred to, processed, and stored on servers located in the United States. We comply with applicable data protection laws regarding international transfers.
9. Children's Privacy
Our Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If we discover that a child under 16 has provided us with personal data, we will promptly delete it.
10. Third-Party Websites
You may opt out of marketing communications by following the unsubscribe instructions provided in each communication. You may also manage cookies and other browser technologies through your browser or device settings as described in Section 4.
If you submitted a property inquiry and no longer want to be contacted about it, you may contact the applicable recipient directly or contact us at support@magicfurnish.com for assistance communicating that request. You may also request deletion of eligible inquiry information maintained by MagicFurnish. An inquiry that has already been transmitted cannot be recalled, and deletion from our systems does not necessarily remove copies independently retained by the recipient.
11. Opt-Out Choices
You may opt out of marketing communications by following the instructions provided in each email. You may also disable cookies through your browser settings to limit tracking.
12. Data Subject Requests
To exercise your rights, contact us at support@magicfurnish.com. We will verify your identity before processing your request and will respond within 30 days of receipt.
13. Your California Privacy Rights
California residents may have rights under the California Consumer Privacy Act, as amended ("CCPA"), including the right to know what personal information we collect, access personal information, request deletion or correction of certain personal information, and, where applicable, opt out of the sale or sharing of personal information.
We do not sell personal information.
When you submit a property inquiry, you direct MagicFurnish to disclose the email address submitted with that inquiry to the uploader, partner, agent, property team, or other listing-side recipient associated with the residence so that the recipient may respond to your inquiry. We treat this as a consumer-directed disclosure rather than a sale of personal information or sharing for cross-context behavioral advertising.
Separately, we may disclose pseudonymous usage or device information to analytics or technology providers. To the extent any such activity constitutes "sharing" under applicable California law, California residents may exercise an applicable right to opt out by contacting us at support@magicfurnish.com.
To exercise applicable California privacy rights, contact us at support@magicfurnish.com. We will not discriminate against you for exercising rights provided by applicable law.
14. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in our practices or applicable laws. If significant changes are made, we will notify you through the Services or via email. Continued use of our services after updates indicates acceptance of the revised policy.

16. Enterprise Partner Integrations
16.1 Scope: This section applies when MagicFurnish is accessed through an embedded integration on a Partner Platform rather than directly through our own website or applications.
16.2 Data Flows: When you interact with MagicFurnish through a Partner Platform, data may flow between the Partner Platform and MagicFurnish through a secure interface. The partner may supply a session reference identifier linking your session to a listing or property record within its system. MagicFurnish generally does not receive your name, email address, or other direct personal identifiers from the Partner Platform solely because you use the embedded experience. However, we may receive or collect personal identifiers when you voluntarily create a MagicFurnish account or provide information directly through the embedded experience, including when you submit a property inquiry. If you submit a property inquiry, your email address is collected and disclosed as described in Sections 3.6 and 3.7.
16.3 Partner Responsibility: Our enterprise partners are independently responsible for obtaining any required consent from their users for the use of MagicFurnish within their platforms, and for providing adequate notice in their own privacy policies.
16.4 Outputs: Upon completion of an interactive session, MagicFurnish may generate a permanent gallery URL that is returned to the Partner Platform. This URL represents a furnished layout associated with a listing and may be stored and shared by the partner in accordance with their own policies.
17. Governing Law
This Privacy Policy is governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising under this Privacy Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut.
