Terms and Conditions

1. Acceptance of Terms

By accessing or using the MagicFurnish platform, you agree to comply with and be bound by the following terms and conditions. If you disagree with any part of these terms, you may not access or use the platform.

 

2. License to Use

MagicFurnish grants you a non-exclusive, non-transferable, revocable license to use the platform. This license does not grant you ownership of any intellectual property rights in the platform or its content. The platform is licensed for personal or professional use only, subject to these terms.

 

3. Liability Disclaimer

3.1 MagicFurnish and its partners are not liable for the accuracy, completeness, or reliability of floor plans or layouts provided through the MagicFurnish platform. All layouts are for inspiration purposes only and should not be relied upon for ADA compliance, building/fire code adherence, structural integrity, or any other regulatory compliance.

3.2 Users acknowledge that floor plans, layouts, and any other content generated through the platform may contain inaccuracies, errors, or omissions. MagicFurnish and its partners disclaim any liability for damages resulting from reliance on such content. Users must independently verify all information before implementation.

3.3 MagicFurnish is not liable for any decisions made or actions taken based on the information or content provided through the platform. Users assume full responsibility for verifying the accuracy and suitability of layouts for their intended use.

 

4. Intellectual Property Rights

4.1 All content, including but not limited to text, images, software, and layouts generated through the platform, remain the property of MagicFurnish and/or its licensors. Users may not copy, modify, distribute, or create derivative works from the platform content without prior written permission.

4.2 Any content uploaded by users, including floor plans and layout data, grants MagicFurnish a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, modify, and display such content in connection with the platform’s operation.

 

5. User Conduct

5.1 Users agree not to upload any content that infringes on the intellectual property rights of others, contains unlawful material, or violates the rights of third parties.

5.2 MagicFurnish reserves the right to remove any content that violates these terms or is deemed inappropriate, harmful, or otherwise objectionable.

 

6. Consent and Information Sharing

6.1 Prior to uploading a floor plan, users must check a consent box acknowledging the liability disclaimer and granting permission for contact information sharing with relevant partners, if applicable.

6.2 Uploaded floor plans may be sent to a monitored partner inbox along with user contact information to facilitate lead generation and follow-up. MagicFurnish and its partners may use this data to provide services or offers related to the platform.

 

7. Data Collection and Usage

7.1 MagicFurnish collects usage data for internal analytics and service improvement. Data collected may include floor plan uploads, interactions with layouts, and engagement metrics. Aggregated, anonymized data may be shared with partners to enhance their service offerings.

7.2 Users may request deletion of their personal data at any time by contacting MagicFurnish support.

 

8. Limitation of Liability

MagicFurnish and its partners are not liable for any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the platform. This includes, but is not limited to, loss of profits, data, or other intangible losses, even if MagicFurnish has been advised of the possibility of such damages.

 

9. Termination

MagicFurnish reserves the right to terminate or suspend user access to the platform at its sole discretion, without prior notice, for violations of these terms or any other reason deemed appropriate.

 

10. Governing Law

These terms are governed by the laws of the State of Connecticut, United States. Any disputes arising from the use of MagicFurnish will be subject to the jurisdiction of Connecticut courts.

 

11. Dispute Resolution

In the event of a dispute arising from the use of the platform, users agree to first attempt to resolve the issue informally by contacting MagicFurnish support. If unresolved, disputes may be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

 

12. Modifications to Terms

MagicFurnish reserves the right to modify these terms at any time. Continued use of the platform after modifications constitute acceptance of the revised terms.
